Terms of Use
1. Scope and Provider
These Terms of Use govern the use of the nube Loyalty App (hereinafter "App"), operated by Nube Café, Kirchgasse 3, 8001 Zurich (hereinafter "nube", "we" or "us").
By registering and using the App, you accept these Terms of Use in full. If you do not agree with these terms, you may not use the App.
2. Description of Services
The nube Loyalty App provides the following features:
- Personal customer account with points balance and transaction history
- Tier-based loyalty programme (Blau, Bronze, Silber, Gold)
- Digital membership card with personal QR code
- Redemption of loyalty points for rewards
- Digital gift cards (purchase and redemption)
- Push notifications for offers and promotions (optional)
- Multilingual support (German / English)
3. Registration and Account
Use of the loyalty programme requires registration with your name, email address, and a password. Providing a phone number is voluntary.
You are obligated to:
- Provide truthful and complete information
- Keep your login credentials confidential and protect them from unauthorised access
- Notify us immediately if you suspect unauthorised use of your account
- Not share or transfer your account to third parties
Only one account per person is permitted. nube reserves the right to deactivate duplicate accounts.
4. Loyalty Programme and Points
The earning and redemption of loyalty points is subject to the following rules:
- Points are credited by staff at the time of purchase at nube Matcha Café
- Points have no monetary value and cannot be cashed out
- Points are non-transferable and may not be sold
- Tier status is based on cumulative total points earned since account creation
- nube reserves the right to modify the points system and redemption conditions at any time
- In cases of suspected abuse (e.g. manipulation or fraudulent point bookings), points may be suspended or revoked without notice
- Points do not expire as long as the account remains active
Loyalty points are a voluntary customer loyalty offering from nube. There is no legal right to the crediting of points or to the continuation of the programme in its current form.
5. Gift Cards
Digital gift cards are subject to the following conditions:
- Gift cards are non-refundable once purchased
- They are redeemable only at nube Matcha Café in Zurich
- Gift cards cannot be exchanged for cash
- nube cannot guarantee a replacement in the event of loss of the access code
- nube reserves the right to deactivate unused gift cards after 3 years
6. Prohibited Use
The following uses are expressly prohibited:
- Manipulation or circumvention of the points system
- Use of automated scripts or bots
- Creating false identities or multiple accounts
- Misuse of the QR code (e.g. duplication or sharing for fraudulent redemption)
- Attempts to gain unauthorised access to or damage the system
- Any use that violates applicable Swiss law
7. Limitation of Liability
nube provides the App to the best of its ability but makes no guarantee of uninterrupted availability, freedom from errors, or fitness for a particular purpose.
nube is not liable for:
- Technical interruptions, data loss, or errors within the App
- Damage caused by unauthorised third-party access to your account where you have failed to adequately protect your login credentials
- Lost points due to technical errors, unless caused by gross negligence on the part of nube
- Content or services provided by external parties (App Stores, Expo services)
Liability for slight negligence is excluded to the extent permitted by law.
8. Availability and Amendments
nube reserves the right to:
- Modify, restrict, or discontinue the App or individual features at any time
- Adjust, suspend, or terminate the loyalty programme
- Update these Terms of Use at any time
Users will be informed of material changes via the App or by email. Continued use of the App after revised terms take effect constitutes acceptance of those changes.
9. Termination and Account Deletion
You may request deletion of your account at any time by contacting us at info@nube.ch. Upon deletion, all points and entitlements under the loyalty programme are permanently forfeited.
nube reserves the right to suspend or delete accounts in the event of a breach of these Terms of Use, without prior notice.
10. Privacy
The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms of Use.
11. Governing Law and Jurisdiction
These Terms of Use are governed by the laws of Switzerland. The exclusive place of jurisdiction for all disputes is Kirchgasse 3, 8001 Zurich, unless mandatory statutory provisions require otherwise.
